Terms of Service

Who we are

Asbilo is a software service for recording, reviewing and billing field work on construction drawings. It is operated by Bandox Corp ("Bandox", "we", "us"). These Terms apply to the company that subscribes to Asbilo ("Customer", "you") and to everyone the Customer invites.

By creating a workspace or using Asbilo, you agree to these Terms on behalf of your company. If you do not have authority to bind your company, do not create a workspace.

Accounts and administrators

The person who creates the workspace becomes its first administrator. Administrators invite users, assign roles and decide who can see each site and project. You are responsible for the people you invite and for keeping sign-in details private.

Tell us right away through the contact form if you believe an account has been misused.

Your data

Drawings, records, photos, notes and other material your users add ("Customer Data") belong to your company. You give us permission to store, process and display Customer Data only to provide and support Asbilo for you.

We do not sell Customer Data and do not use it for advertising. Our staff access Customer Data only when you ask for support, when needed to keep the service secure and working, or when required by law. We may use aggregated usage measurements, such as storage and activity counts that do not identify your records, to run and improve the service.

You can export your records at any time as CSV files, marked-up PDFs and closeout packages.

Acceptable use

Do not use Asbilo to break the law, to infringe others' rights, to upload malicious code, to probe or overload the service, or to access another company's workspace. Do not upload material you are not allowed to share, including drawings or photos restricted by a project owner or site rules. We may suspend access that puts the service or other customers at risk.

Plans, billing and taxes

Asbilo is billed monthly by company. The current plan is $49.99 per month and includes 50 GB of storage. Storage is measured once a day as the drawings, revisions and photos your company keeps; storage above the included amount is billed at $0.25 per GB per month based on the amount at the end of the billing period.

Payments are processed by Stripe. Prices do not include taxes, which are added where required. We will give at least 30 days' notice before a price change takes effect for an existing subscription.

Missed payments

If a payment fails, Stripe retries it. If the invoice remains unpaid, your workspace becomes read-only: you can still sign in, view and export your records, but new changes are not saved until the invoice is paid. We do not delete Customer Data because of a missed payment.

Cancellation

Administrators can cancel at any time from Billing. Cancellation takes effect at the end of the current billing period, and fees already paid are not refunded except where the law requires.

After a subscription ends, the workspace stays available in read-only form for at least 90 days so you can export your records. You may ask us to delete your workspace; we will do so within 30 days of the request, except for copies in backups, which expire on their normal schedule.

Service and support

We work to keep Asbilo available and secure, but we do not promise uninterrupted service. Planned maintenance is scheduled outside normal US working hours when possible. Support is provided by e-mail and through the contact form.

Field use

Asbilo helps document work. It does not replace professional judgment, contract documents, inspections, codes or safety rules. Measured quantities depend on the drawings and scales you provide; review quantities before relying on them for payment applications.

Third-party services

Asbilo relies on service providers such as DigitalOcean for hosting, Stripe for payments and Resend for e-mail. Their handling of information is described in our Privacy Policy.

Disclaimers

Except as expressly stated in these Terms, Asbilo is provided "as is" and "as available", and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, to the extent permitted by law.

Limitation of liability

To the extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue. Our total liability for any claim relating to Asbilo is limited to the amount you paid us in the 12 months before the event that gave rise to the claim.

Changes to these Terms

We may update these Terms. If a change materially affects your rights, we will tell administrators by e-mail or in the app at least 30 days before it takes effect. Continuing to use Asbilo after that date means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in Texas.
